These Terms & Conditions of Sale apply to purchases made through the LUCALEXANDRA online shop.

By placing an order through the shop, you agree to these Terms & Conditions.

1. About me

LUCALEXANDRA is the artist website and online shop of Luca Alexandra Lukacs, a self-employed artist based in the United Kingdom.

2. Artwork and product information

I make and sell original artwork and art prints through the LUCALEXANDRA online shop.

I make every effort to ensure that artwork descriptions, photographs, dimensions, colours and other product information are accurate.

However, please be aware that:

  • colours may appear slightly different depending on your screen or device;

  • photographs may not show the exact scale or texture of an artwork;

  • each artwork may have individual characteristics resulting from the artistic process;

  • measurements are provided as accurately as reasonably possible.

For original or individually produced artworks, minor variations or imperfections that are consistent with the nature of the artwork are not necessarily considered defects.

3. Prices

All prices are displayed in GBP (£) unless otherwise stated.

Prices may change from time to time, but any change will not affect an order that I have already accepted.

The price applicable to your order is the price displayed when you place your order.

Any applicable delivery charges will be shown before you complete your purchase.

4. Placing an order

When you place an order through the online shop, you are making an offer to purchase the artwork or product shown in your order.

After placing your order, you should receive an acknowledgement confirming that your order has been received.

An order acknowledgement does not necessarily mean that your order has been accepted.

I will accept your order when I confirm that the order has been accepted and/or when I dispatch the artwork to you.

If I am unable to accept your order, for example because an item is unavailable or there has been an obvious pricing or product error, I will contact you and refund any payment you have made for the affected order.

5. Payment

Payments are processed securely through Squarespace Payments.

I do not directly store your full payment card details.

Payment must be successfully completed before an order can be processed and dispatched, unless otherwise agreed.

6. Delivery

I prepare and dispatch orders myself.

The available delivery options and applicable delivery charges will be displayed during checkout.

I aim to dispatch orders within the timeframe stated on the product page or at checkout. Delivery times may vary depending on the destination and delivery service used.

Once your order has been dispatched, you will be responsible for providing an accurate delivery address.

If an order is delayed or appears to have been lost in transit, please contact me at lucalexandralukacs@gmail.com and I will work with you to resolve the issue.

For international orders, you may be responsible for customs duties, import taxes or other charges imposed by the destination country. These charges are outside my control.

7. Risk and responsibility for the artwork

For physical artwork and art prints, responsibility for the artwork passes to you when you, or a person you nominate, takes physical possession of it.

If you have nominated a carrier that was not offered by me, responsibility may pass to you when the artwork is handed to that carrier, where permitted by law.

Please inspect your artwork when it arrives and contact me as soon as reasonably possible if it has been damaged during delivery.

8. Cancellations and your legal rights

If you are a UK consumer purchasing artwork online, you may have a legal right to cancel your order within 14 days of receiving the artwork, without giving a reason, subject to applicable legal exceptions.

Please provide your name and order details so that I can identify the purchase.

If you cancel under the applicable consumer cancellation rules, you must return the artwork to me without undue delay and, in any event, normally within 14 days of telling me that you wish to cancel.

Unless the artwork is faulty, incorrect or otherwise does not conform to the contract, you may generally be responsible for the direct cost of returning the artwork when the law allows this.

I will process any refund due to you in accordance with applicable consumer law.

Exceptions

The statutory cancellation right does not apply to every type of product. For example, certain personalised or custom-made items may be excluded from the right to cancel where the law permits.

Where an artwork is personalised or made specifically to your requirements, I will make this clear before you purchase.

Nothing in these Terms & Conditions affects your statutory consumer rights.

9. Faulty, damaged or incorrect artwork

Your statutory rights are not affected by these Terms & Conditions.

If your artwork:

  • arrives damaged;

  • is faulty;

  • is materially different from the description;

  • is the wrong item; or

  • otherwise does not conform to the contract,

please contact me at lucalexandralukacs@gmail.com as soon as possible, preferably with photographs of the issue where relevant.

I will assess the issue and provide the remedy you are legally entitled to, which may include a repair, replacement, refund or other appropriate remedy depending on the circumstances.

10. Returns

Where a return is agreed or required, I will provide instructions for returning the artwork.

Please package returned artwork carefully and, where appropriate, use a tracked or insured delivery service.

I cannot accept responsibility for damage caused by inadequate packaging during a return.

This does not affect your statutory rights where an item is faulty, damaged or otherwise does not conform to the contract.

11. Artwork ownership and copyright

When you purchase physical artwork or an art print from me, you purchase the physical item, not the copyright or other intellectual property rights in the artwork.

Unless otherwise agreed in writing, I retain all copyright and intellectual property rights in my artwork.

You may not reproduce, copy, distribute, commercially exploit or create derivative works from the artwork without my prior written permission, except where permitted by law.

I may continue to display images of sold artwork in my portfolio, archive, exhibitions, social media, website and other promotional or artistic contexts, unless we have agreed otherwise in writing.

12. Digital artwork

Where a product is supplied as a digital file rather than a physical artwork, additional terms may apply concerning downloading, access and permitted use.

Unless expressly stated otherwise, purchasing a digital artwork does not transfer copyright to you.

You may not reproduce, resell, redistribute or commercially exploit a digital artwork unless I have expressly given you permission to do so.

Where the law provides a cancellation right for digital content, that right may be affected once you have agreed to the digital content being supplied immediately and acknowledged the consequences of doing so.

13. Custom and commissioned artwork

If I agree to create a custom or commissioned artwork for you, I will confirm the specific terms of the commission before work begins.

These may include:

  • the agreed price;

  • deposit or payment arrangements;

  • expected timeframe;

  • artwork dimensions;

  • materials or format;

  • number of revisions, where applicable;

  • delivery arrangements; and

  • any specific usage or licensing rights.

A commission may be subject to different cancellation or return arrangements because it is created specifically for you.

14. Events outside my control

I will not be responsible for delays or failure to perform my obligations where this is caused by circumstances beyond my reasonable control.

This may include events such as postal or courier disruption, natural disasters, serious technical problems, power outages or other circumstances that I could not reasonably prevent.

Where this happens, I will take reasonable steps to minimise the impact and keep you informed where appropriate.

15. Website information and errors

I take reasonable care to ensure that information on the website is accurate.

Occasionally, errors may occur, including typographical errors, incorrect product information or pricing errors.

If an obvious error affects your order, I may contact you to correct the error or cancel the affected order and provide a refund where appropriate.

16. Privacy

Personal information provided when you place an order is handled in accordance with my Privacy Policy.

This includes information needed to process payment, fulfil your order, communicate with you and arrange delivery.

17. Governing law

These Terms & Conditions are governed by the laws of England and Wales.

If you are a consumer, you will also retain any mandatory rights and protections that apply to you under the laws that apply to your circumstances.

18. Changes to these Terms

I may update these Terms & Conditions from time to time.

The version that applies to your purchase will be the version in effect when you place your order.
